END USER LICENSE AGREEMENT

SHORT TERMS
- Do not distribute the Typefaces in any form.
- Do not modify the Typefaces in any form.
- Do not use the Typeface for Apps or as a web font (This requires a special license)
- Do not use the Typefaces at more systems, as indicated in the invoice.

DEFINITIONS
This is an End User License Agreement (EULA) between you (the End User) and HVD Fonts GmbH. Please read this Agreement carefully. By downloading and/ or installing HVD Fonts GmbH Font Software, you are agreeing to the terms of this license. Subject of the contract are the software and the Typefaces (?fonts?), which shall be made available by HVD Fonts GmbH. All Typefaces and all soft- ware on this website are the intellectual property of HVD Fonts GmbH.


GRANT OF LICENSE
HVD Fonts GmbH grants you a non-exclusive, non-transferable license to oper- ate its font software on a fixed number of computers at a single location, as indicated on your invoice. You agree not to duplicate, reproduce, sell, transfer, license, or otherwise distribute the Typefaces in any form, except as provided herein. You agree not to decompile, modify, reformat, translate, reverse- engineer or otherwise discover the source code of the Typefaces. You agree not to make, or authorize or commission others to make, any additions, deletions or modifications to the Typefaces without the prior written consent of HVD Fonts GmbH. You agree not to alter HVD Fonts GmbH?s copyright notices as contained in the Typefaces.


COPYRIGHT
HVD Fonts GmbH retains full title and ownership of these Typefaces both as artwork and software, including all subsequent copies of the artwork or software regardless of the format in which they are expressed or the media on which they are recorded. Any updates, revisions, enhancements or additions to the Typefaces supplied by HVD Fonts GmbH under this Agreement shall become part of, and subject to, this Agreement. The parties agree that HVD Fonts GmbH shall own the copyright in all such modifications and derivative works of the Typefaces made by either party. The names of these typefaces are trademarks of HVD Fonts GmbH, and as such may only be used in keeping with accepted trademark practice, including identification of the trademark owner?s name and only in conjunction with output produced using this font software. The parties agree that the Typefaces are the sole and exclusive property of HVD Fonts GmbH, including all applicable rights to patents, copyrights, trademarks and trade secrets inherent therein and appurtenant thereto, and you agree not to challenge HVD Fonts GmbH?s rights thereto, or infringe the rights thereof. You acknowledge that you are not purchasing title to the Typefaces, but are rather being granted a license to use the Typefaces for the purposes set forth above. Except as provided herein, this Agreement does not grant you any intellectual property rights in the Typefaces.


USE RESTRICTIONS
The typefaces and the software shall not be copied at more computer systems, as indicated in the invoice, which you get from HVD Fonts GmbH. The typefaces and the software shall not be used together with or copied for any third parties. The typefaces and the software shall not be sublicensed or resold, rented or made available in any other manner to any third party. This applies in particular also to parts of typefaces, copies of parts or modifications of the typefaces. This license does not allow the use of a typeface in a manner where the type- face becomes the primary aspect of a product for resale. This license does not allow the embedding of a typeface in an Application (ios, android or any other mobile app; this requires a special license -> mail to hannes@hvdfonts.com). This license does not allow to convert the typeface into EOT or WOFF files and em- bed them into a website via @font-face; there are special screen-optimized web fonts and you need a special web font license -> mail to hannes@hvdfonts.com). Modifying the typefaces is prohibited, even in the event that it is necessary for fulfilling personal design requirements. Embedding of the typefaces and the software into electronic documents like PDF is permitted in a secured ?Preview & Print? mode. Licensee must ensure that recipients of electronic documents cannot extract the typefaces and the software from such documents or use the embedded typefaces and the software for the creation of new documents. The typefaces may not be modified, adapted, translated, de compiled, disassembled, re digitized, rented, sold, given away, leased, sub-licensed or loaned in any form. Additionally, you agree to take all steps necessary to prevent any third person from duplicating or distributing any typefaces and the software. Defamatory, offensive, pornographic or otherwise unlawful uses of the Typefaces and the software are prohibited.
Warranty

HVD Fonts GmbH warrants the typefaces and the software are free from defects in material and workmanship for 90 days as of the date of purchase. During this 90-day period, in the event of defect, HVD Fonts GmbH will replace any defective products which are returned to HVD Fonts GmbH. Your exclusive remedy for the breach of these warranties is the replacement of the product or the refund of the purchase price. HVD Fonts GmbH makes no other warranty, express or implied, including, without limitation, any implied warranties of merchantability or fitness for a particular purpose. HVD Fonts GmbH shall not be liable to you for any general, special, direct or indirect damage.
Liability

In no event will HVD Fonts GmbH be held liable for any consequential or incidental damages, including any lost profits or lost savings, or for any claim by any party, even if HVD Fonts GmbH has been apprised of the possibility of such damages.

TERMINATION
This license agreement will terminate automatically without notice from HVD Fonts GmbH if you breach any of its provisions. With termination, you must immediately stop using the typefaces and the software and delete all copies of the Typefaces and the software from all medias. All rights to the typefaces, including their names and the software are owned by HVD Fonts GmbH are protected by the copyright laws of Germany and other international provisions. If any part of this contract is found void and enforceable, it will not affect the validity of the balance of the contract, which shall remain valid andenforceable according to its terms.

Once downloaded, fonts may not be returned or refunded.
